This website www.chutcharlotte.com (the "Site") is published by CHUT CHARLOTTE LTD, a company limited liability, registered in HK under number 0585894 ("CHUT CHARLOTTE").

Preamble

These general conditions of sale (the "General Conditions") are concluded between CHUT CHARLOTTE and any non-commercial natural person (the "Customer") wishing to make a purchase on the Site ( the "Parts").

The Parties agree that these General Conditions exclusively govern their relationship. CHUT CHARLOTTE reserves the right to modify the General Conditions from time to time. They will be applicable as soon as they are put online.

1 - Object

The General Conditions are intended to define the terms of sale between CHUT CHARLOTTE and the Customer, from placing the order to after-sales service, including payment and delivery.

2 - Products

The products governed by these General Conditions are those appearing on the site (the "Products"). They are offered within the limits of available stocks.

The Products are described and presented with the greatest possible accuracy. However, if errors or omissions occur in this presentation, CHUT CHARLOTTE cannot be held liable.

The elements of description as well as the photographs of the Products are not contractual.

3 - Price

The prices of the Products are indicated in Euros, all taxes included.

The prices of the Products are exclusive of delivery costs (postage, packaging and making of the parcel, according to the amounts in force). The amount of the delivery costs is specified on the order form before validation of the order.

A price cannot be changed once the Customer's order has been validated.

4 - Command

To place an order, the Customer must identify himself with his email address.

The Customer places his order online from the product catalog. Once the basket has been validated, the Customer must accept the General Conditions, choose the address and the delivery method, and finally validate the method of payment, this last step formalizing the sales contract between CHUT CHARLOTTE and the Customer.

Any order implies acceptance of the prices and descriptions of the products available for sale.

CHUT CHARLOTTE acknowledges receipt of the order upon validation by sending an email to the Customer.

In certain cases, in particular non-payment, incorrect address or other problem on the Customer's account, CHUT CHARLOTTE reserves the right to put the Customer's order on hold until problem solved.

CHUT CHARLOTTE reserves the right to cancel or refuse an order in the event of a dispute with the Customer on a previous order.

If, despite the vigilance of CHUT CHARLOTTE, certain products are unavailable, CHUT CHARLOTTE informs the Customer by e-mail as soon as possible. The Customer can then cancel his order and be reimbursed, if necessary, for the sums already paid.

Permanent or temporary unavailability cannot in any way engage the responsibility of CHUT CHARLOTTE, nor can it give rise to any right to compensation or damages in favor of the Customer.

5 - Payment

The Customer pays for his purchases by credit card or via Paypal

Full payment must be made when ordering. At no time can the amounts paid be considered as deposits or installments. No cash on delivery is accepted, whatever the reason.

Purchases are made securely. The payment solutions adopted by CHUT CHARLOTTE are completely secure. All information that Customers communicate to CHUT CHARLOTTE is strictly protected and guarantees the compliance and security of each transaction.

6 - Delivery

CHUT CHARLOTTE delivers its products to any country.

The delivery times indicated on the site are indicative times, corresponding to the average processing and delivery times. In order for these deadlines to be respected, the Customer must ensure that he has communicated exact and complete information concerning the delivery address (such as, in particular: street number, building, staircase, access codes , names and/or intercom numbers, etc.).

CHUT CHARLOTTE undertakes to inform the Customer of the progress of the processing of his order.
In the event of a damaged package (already opened, product missing(s)…), the Customer undertakes to notify the carrier and CHUT CHARLOTTE of any reservations within 3 days of receipt of the product.

CHUT CHARLOTTE cannot be held responsible for the consequences due to a delay in delivery that is not its fault.

7 - Right of withdrawal and exchange

Within seven (7) days of receipt of their order, the Customer may request the return or exchange of the Product(s), EXCEPT for personalized items (change of Liberty, modification of length for a garment, etc.) and for Products on Promotion ("Sales" section of the site).

To do this, the Customer first submits a return or exchange request by e-mail.

The return or exchange is at the Customer's risk. The Product must be returned in its original packaging, in its original condition, new, unused, unwashed, to the following address:

The returned Product will be refunded within a maximum period of twenty (20) days from receipt by CHUT CHARLOTTE.

Return costs are the responsibility of the customer, unless CHUT CHARLOTTE has delivered a product that is damaged or different from the item ordered. In this case, CHUT CHARLOTTE will also reimburse the shipping costs paid by the customer.

If the item is not returned by the Customer within two weeks after contacting them by email, the return is considered canceled and the Customer must keep the product .

If the Customer fails to comply with these conditions, in particular the return or exchange conditions, CHUT CHARLOTTE will not be able to refund the Products concerned.

8 - Warranties

All the Products for sale on the Site benefit from the legal guarantee of conformity and the guarantee against hidden defects, allowing the Customer to return the Products delivered which are defective or non-compliant.

Cthis guarantee does not cover products damaged following an accident of use by the Customer.If the product is damaged by the Customer and not due to a manufacturing defect, the transport costs for returning the product and repair are the responsibility of the Customer

This warranty also does not cover imperfections inherent in handcrafted fabrics or handcrafted pieces.

The Product must be returned in its original packaging, in its original condition, new, unused, unwashed, and with the label(s) of origin not having been detached for inspection of the product by CHUT CHARLOTTE.

9 - Signature and evidence

The final validation and the payment of the order are proof of the entirety of the said order and are worth payment of the sums committed by the entry of the Products appearing on the order form. This validation is equivalent to signature and express acceptance of all operations carried out on the Site.

However, in the event of fraudulent use of their credit card or PAYPAL account, the Customer is invited to contact CHUT CHARLOTTE as soon as such use is observed.

The computerized registers, kept in the computer systems of CHUT CHARLOTTE and its partners under reasonable security conditions, will be considered as proof of communications, orders and payments made between the parts. Archiving of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy.

10 - Responsibilities

CHUT CHARLOTTE cannot be held liable in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable event of a third party to the contract or to a case of force majeure.

Similarly, CHUT CHARLOTTE cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.

11 - Intellectual Property

Under no circumstances is the Customer authorized to download or modify all or part of the Site and in particular its content (listed products, descriptions, images, videos, etc.). The Site or any part of the Site must under no circumstances be reproduced, copied, sold or exploited for commercial reasons without the express written authorization of CHUT CHARLOTTE.

In general, all copyrights, trademarks and other distinctive signs and property or intellectual property rights appearing on the Site remain the full and entire property of SHH CHARLOTTE.

The Customer is therefore required to respect intellectual property rights and may not in any way use the trademarks appearing on the Site and on the Products, where applicable, or register a trademark that would prejudice to the owner of the rights, unless otherwise provided by contract.

12 - Personal information

The personal data collected by CHUT CHARLOTTE is subject to computer processing, of which the Customer acknowledges being aware. CHUT CHARLOTTE undertakes to use the confidential information of Customers only in the context of the operation of its Site. As such, information concerning him may be communicated to technical service providers of CHUT CHARLOTTE.

This computer processing has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL), which issued receipt no. 1772622
